What If You Get a DUI While Your License Is Suspended?

If you get a DUI in Oklahoma while your license is suspended, you could be charged with an additional crime that comes with more penalties. Your license could be suspended for many different reasons, but all will lead to fines and potentially prison time if you drive while intoxicated and with a suspended license.

What Are the Penalties for Driving with a Suspended License and DUI?

If you are caught driving with a suspended license and also appear intoxicated, you may be arrested both for the suspended license violation and a suspected DUI. The law enforcement officer will probably have you take a breathalyzer test and do roadside sobriety tests.

In addition to the Oklahoma DUI penalties, you may be charged with driving with a suspended license. This is a misdemeanor in Oklahoma carrying fines and prison time depending on whether you have previous convictions. The fines may be as follows:

  • $100 to $500 (first conviction)
  • $200 to $750 (second conviction)
  • $300 to $1,000 (third or subsequent conviction)

Also, you could receive a sentence of up to one year of imprisonment, and your license suspension period may be extended for three months. 47 O.S. §§ 6-303(B), (D).

What Are the Penalties If You Had a Previous DUI and Then Drive on a Suspended License?

If you were previously convicted of a DUI and then are caught driving on a license suspended because of the DUI, the penalties are more severe. The same is true if you were convicted of some other alcohol-related offenses. The fines may be as follows:

  • $500 and $1,000 (first conviction)
  • $1,000 and $2,000 (second conviction)
  • $2,000 and $5,000 (third or subsequent conviction)

Also, you could receive a sentence of up to one year of imprisonment, and your license suspension period may be extended for at least four months. 47 O.S. §§ 6-303(C), (E).
